(a) The designation of any teacher to any given class shall be determined by the department in accordance with licensing requirements.

Terms Used In Hawaii Revised Statutes 302A-618

  • Board: means the board of education. See Hawaii Revised Statutes 302A-101
  • Department: means the department of education. See Hawaii Revised Statutes 302A-101
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Teacher: means a person whose duties in the public educational system are primarily teaching or instruction of students or related activities centered primarily on students and who is in close and continuous contact with students, and shall include but not be limited to classroom teachers, school librarians, counselors, registrars, and special education teachers. See Hawaii Revised Statutes 302A-101
(b) Any teacher teaching technical school courses who is transferred to a community college under the jurisdiction of the board of regents of the University of Hawaii shall not suffer any loss of salary, seniority, prior service credit, vacation, sick leave, or other employee benefit or privilege.
(c) Beginning with the 2002-2003 school year, this section shall be interpreted as though the terms “certification” and “certificate” read “licensing” and “license”, as the latter terms are used in subpart D, and as circumstances require.
