Terms Used In Hawaii Revised Statutes 346-402
- Court: means one of the family courts established pursuant to chapter 571. See Hawaii Revised Statutes 346-392
- Party: means the department or the young adult who is subject to a proceeding brought under this part and may include any other person whose participation the court finds is in the best interest of the young adult. See Hawaii Revised Statutes 346-392
- Young adult: means a person who has attained the age of eighteen or older, but is less than twenty-one years of age. See Hawaii Revised Statutes 346-392
The court may appoint an attorney sua sponte or at the request of any party to represent a young adult who is eligible under § 346-395 and has signed the voluntary care agreement as described in section [346-396] if it is deemed by the court to be in the young adult’s best interest. Attorneys who are appointed by the court to represent a qualifying young adult may be paid by the court, unless the young adult for whom counsel is appointed has an independent estate sufficient to pay fees and costs.
