Upon a showing that there exists a danger that the defendant will commit a serious crime or will seek to intimidate witnesses, or will otherwise unlawfully interfere with the orderly administration of justice, the judicial officer named in § 804-5 may deny the defendant’s release on bail, recognizance, or supervised release.

- Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
provided that the court shall impose the least restrictive non-financial conditions required to ensure the defendant’s appearance and to protect the public.
The judicial officer may revoke a defendant’s bail upon proof that the defendant has breached any of the conditions imposed.
