No civil action may be brought by a prisoner confined in a state, local or private correctional facility for mental or emotional injury suffered while in custody without a prior showing of either:
(1)  Physical injury; or

Terms Used In Idaho Code 19-4222

  • Correctional facility: means a facility for the confinement of prisoners. See Idaho Code 19-4201A
  • Prisoner: includes an in-state or out-of-state prisoner, unless otherwise specifically provided or unless the context clearly indicates otherwise. See Idaho Code 19-4201A
  • State: when applied to the different parts of the United States, includes the District of Columbia and the territories; and the words "United States" may include the District of Columbia and territories. See Idaho Code 73-114
(2)  Diagnosed severe and disabling mental illness.
