Each facility must:
(1) Inform each resident, orally and in writing at the time of admission to the facility, of his legal rights during the stay at the facility.
Terms Used In Idaho Code 39-3317
- Abuse: means a nonaccidental act of sexual, physical or mental mistreatment or injury of a resident through the action or inaction of another individual. See Idaho Code 39-3302
- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- Facility: means a residential care or assisted living facility. See Idaho Code 39-3302
- Licensing agency: means the unit of the department of health and welfare that conducts inspections and surveys and issues licenses based on compliance with this chapter. See Idaho Code 39-3302
- Neglect: means failure to provide food, clothing, shelter, or medical care necessary to sustain the life and health of a resident. See Idaho Code 39-3302
- Property: includes both real and personal property. See Idaho Code 73-114
- Resident: means an adult who lives in a residential care or assisted living facility. See Idaho Code 39-3302
(2) Make available to each resident, upon reasonable request, a written statement of such rights (which statement is updated upon changes in such rights).
(3) The written description of legal rights under this subsection shall include a description of the protection of personal funds and a statement that a resident may file a complaint with the licensing agency respecting resident abuse and neglect and misappropriation of resident property in the facility. A copy of the list of resident rights shall be conspicuously posted in the facility at all times.
