The provisions of this unauthorized insurers process act shall not apply to any action, suit or proceeding against any unauthorized foreign or alien insurer arising out of any contract of:
(1)  Reinsurance, ocean marine, aircraft or railway insurance;

Terms Used In Idaho Code 41-1210

  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • Contract: A legal written agreement that becomes binding when signed.
  • Property: includes both real and personal property. See Idaho Code 73-114
  • State: when applied to the different parts of the United States, includes the District of Columbia and the territories; and the words "United States" may include the District of Columbia and territories. See Idaho Code 73-114
(2)  Insurance effectuated in accordance with the surplus line law or any amendments or supplements thereto;
(3)  Insurance against legal liability arising out of the ownership, operation or maintenance of any property having a permanent situs outside this state; or
(4)  Insurance against loss of or damage to any property having a permanent situs outside this state;
Where such contract of insurance contains a provision designating the director or a bona fide resident of Idaho to be the true and lawful attorney of such unauthorized insurer upon whom may be served all lawful process in any action, suit or proceeding instituted by or on behalf of an insured or beneficiary arising out of such contract or where the insurer enters a general appearance in any such suit, action or proceeding.
