Terms Used In Idaho Code > Title 66 > Chapter 14 - Secure Treatment Facility Act
- Administrator: means the administrator of the secure treatment facility. See Idaho Code 66-1403
- Adult: means an individual eighteen (18) years of age or older. See Idaho Code 66-1403
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- Department: means the Idaho department of health and welfare. See Idaho Code 66-1403
- Developmental disability: means a developmental disability as defined in section 66-402, Idaho Code, or an intellectual disability as defined in section 73-114, Idaho Code. See Idaho Code 66-1403
- Director: means the director of the department. See Idaho Code 66-1403
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- Intellectual disability: means significantly subaverage general intellectual functioning that is accompanied by significant limitations in adaptive functioning in at least two (2) of the following skill areas: communication, self-care, home living, social or interpersonal skills, use of community resources, self-direction, functional academic skills, work, leisure, health and safety. See Idaho Code 73-114
- Person: means an individual subject to judicial proceedings authorized by the provisions of this chapter who is being considered for disposition or is admitted and dispositioned into the secure treatment facility. See Idaho Code 66-1403
- Property: includes both real and personal property. See Idaho Code 73-114
- secure treatment facility: means the facility to be operated by the department to fulfill the purposes of this chapter. See Idaho Code 66-1403
- Serious mental illness: means any of the following psychiatric illnesses as defined by the American psychiatric association in the diagnostic and statistical manual of mental disorders (DSM):
Idaho Code 66-1403State: when applied to the different parts of the United States, includes the District of Columbia and the territories; and the words "United States" may include the District of Columbia and territories. See Idaho Code 73-114 Substantial threat to the safety of others: means the presentation, by a person, of a substantial risk to physically harm other individuals, as manifested by evidence of violent behavior. See Idaho Code 66-1403 Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
