  • Abuse: means a nonaccidental act of sexual, physical or mental mistreatment or injury of a resident through the action or inaction of another individual. See Idaho Code 39-3302

  • Activities of daily living: means the performance of basic self-care activities in meeting an individual’s needs to sustain him in a daily living environment. See Idaho Code 39-3302

  • Adjourn: A motion to adjourn a legislative chamber or a committee, if passed, ends that day's session.
  • Administrator: means an individual, properly licensed by the division of occupational and professional licenses, who is responsible for day-to-day operation of a residential care or assisted living facility. See Idaho Code 39-3302

  • Advanced practice registered nurse: means a professional nurse licensed in this state who has gained additional specialized knowledge, skills, and experience through a nationally accredited program of study as defined by section 54-1402, Idaho Code, and is authorized to perform advanced nursing practice, which may include direct client care such as assessing, diagnosing, planning, and prescribing pharmacologic and nonpharmacologic therapeutic and corrective measures, health promotion, and preventive care as defined by rules of the board of nursing.   • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
  • Allegation: something that someone says happened.
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Amortization: Paying off a loan by regular installments.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Applicant: means an individual submitting documents required by the department of health and welfare for the purpose of requesting a grant from the rural nursing loan repayment program. See Idaho Code 39-2502
  • Applicant: means an entity submitting documents required by the community health center grant program for the purpose of requesting a grant from the community health center grant fund. See Idaho Code 39-3203
  • Application period: means the time period from October 1 to November 30 of the state fiscal year for which funding is requested. See Idaho Code 39-2502

  • Assessment: means the conclusion reached using uniform criteria, which identifies resident strengths, weaknesses, risks and needs, to include functional, medical and behavioral needs. See Idaho Code 39-3302

  • Authority having jurisdiction: means a city fire department if the area is within a city, or a fire protection district formed pursuant to provisions of the Idaho Code if the area is within a fire protection district, or the county commission if the area is not within a city or fire protection district. See Idaho Code 39-2602
  • Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
  • Baseline: Projection of the receipts, outlays, and other budget amounts that would ensue in the future without any change in existing policy. Baseline projections are used to gauge the extent to which proposed legislation, if enacted into law, would alter current spending and revenue levels.
  • Board: means the board of health and welfare. See Idaho Code 39-2402

  • Camping trailer: means a vehicular portable unit mounted on wheels and constructed with collapsible partial side walls which fold for towing by another vehicle and unfold at the campsite to provide temporary living quarters for recreational, camping or travel use. See Idaho Code 39-4201
  • Care provider: means the adult member of the home family responsible for maintaining the certified family home. See Idaho Code 39-3502
  • Certified family home: means a family-styled living environment in which two (2) or fewer adults live who are not able to reside in their own home and who require care, help in daily living, protection and security, supervision, personal assistance and encouragement toward independence. See Idaho Code 39-3502
  • Client: means any person who receives financial aid and/or services from an organized program of the department. See Idaho Code 39-3502
  • Closed construction: means any manufactured building, structure or component thereof that may enclose factory installed structural, mechanical, electrical or plumbing systems and is not open for visual inspection at the building site. See Idaho Code 39-4301
  • Comfort care: means treatment that may include oxygen and medicine to relieve pain and symptoms but does not include artificial life support, artificial hydration, and artificial nutrition. See Idaho Code 39-4502
  • Commercial hazardous waste facility or site: means any hazardous waste facility whose primary business is the treatment, storage or disposal, for a fee or other consideration, of hazardous waste generated offsite by generators other than the owner and operator of the facility. See Idaho Code 39-4403
  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Community health center grant: means a grant awarded pursuant to this chapter. See Idaho Code 39-3203
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Consent to treatment: means the agreement an individual makes to receive health care services. See Idaho Code 39-4502
  • Construction: means the erection, fabrication, reconstruction, demolition, alteration, conversion, or repair of a building or the installation of equipment therein normally a part of the structure. See Idaho Code 39-4105
  • Continuance: Putting off of a hearing ot trial until a later time.
  • Contract: A legal written agreement that becomes binding when signed.
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • CPR: means measures to restore cardiac function and/or to support ventilation in the event of cardiac or respiratory arrest. See Idaho Code 39-4502
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Decedent: A deceased person.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Department: means the department of health and welfare. See Idaho Code 39-2402

  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one.   • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.

  • Exploitation: means the misuse of a resident’s funds, property, resources, identity or person for profit or advantage. See Idaho Code 39-3302

  • Fifth-wheel trailer: means a vehicular unit, mounted on wheels, designed to provide temporary living quarters for recreational, camping or travel use, of such size or weight as not to require special highway movement permits, of gross trailer area not to exceed four hundred (400) square feet in the set-up mode, and designed to be towed by a motorized vehicle that contains a towing mechanism that is mounted above or forward of the tow vehicle’s rear axle.   • Fireworks: means any combustible or explosive composition, or any substance or combination of substances, or article prepared for the purpose of producing a visible or audible effect by combustion, explosion, deflagration or detonation. See Idaho Code 39-2602
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Forgery: The fraudulent signing or alteration of another's name to an instrument such as a deed, mortgage, or check. The intent of the forgery is to deceive or defraud. Source: OCC

  • Gate ton: means the weight, in tons (2,000 pounds/ton), of waste material received at a facility. See Idaho Code 39-4403
  • Generator: means any person, who by virtue of ownership, management, or control, is responsible for causing or allowing to be caused the creation of a hazardous waste. See Idaho Code 39-4403
  • Germane: On the subject of the pending bill or other business; a strict standard of relevance.
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Governmental unit: means the state, any county, any city, other political subdivision, or any department, division, board, or other agency thereof. See Idaho Code 39-3302
  • grant: means a grant awarded pursuant to this chapter. See Idaho Code 39-2502
  • Grant period: means the time immediately following the application period from December 1 through June 30 for which funding is granted. See Idaho Code 39-2502

  • Individual: means a natural person who is a recipient of provided health care services. See Idaho Code 39-2402
  • Injection: means the subsurface emplacement of free liquids. See Idaho Code 39-4403
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Intellectual disability: means significantly subaverage general intellectual functioning that is accompanied by significant limitations in adaptive functioning in at least two (2) of the following skill areas: communication, self-care, home living, social or interpersonal skills, use of community resources, self-direction, functional academic skills, work, leisure, health and safety.   • International Fire Code: means the International Fire Code as published by the International Code Council. See Idaho Code 39-4105
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.

  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
  • Local government: means any city or county of this state. See Idaho Code 39-4105
  • Manifest: means a form used for identifying the quantity, composition, origin, routing, waste identification code(s), and destination of hazardous waste during any transportation from the point of generation to the point of treatment, storage or disposal. See Idaho Code 39-4403
  • Manifested waste: means waste which at the point of origin or generation is required to be manifested for transportation in a manner similar to that of the federal uniform hazardous waste manifest or by other manifest requirements designed to assure proper treatment, storage and disposal of such waste.   • Manufactured home: means a structure, constructed after June 15, 1976, in accordance with the HUD manufactured home construction and safety standards, and is transportable in one (1) or more sections, which, in the traveling mode, is eight (8) body feet or more in width or is forty (40) body feet or more in length, or when erected on site, is three hundred twenty (320) or more square feet, and which is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities, and includes the plumbing, heating, air conditioning, and electrical systems contained therein, except that such term shall include any structure which meets all the requirements of this subsection except the size requirements and with respect to which the manufacturer voluntarily files a certification required by the secretary of housing and urban development and complies with the standards established under 42 U.   • Manufactured home: means a structure as defined in section 39-4105, Idaho Code. See Idaho Code 39-4301

  • Person: means any individual, association, partnership, firm, joint stock company, trust, estate, political subdivision, public or private corporation, state or federal governmental department, agency, or instrumentality, or any other legal entity which is recognized by law as the subject of rights and duties.   • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire.   • Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.

  • program: means the rural nursing loan repayment program established by this chapter. See Idaho Code 39-2502
  • Property: includes both real and personal property. See Idaho Code 73-114
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • provider: means any person or entity licensed, certified, or otherwise authorized by law to administer health care services in the ordinary course of business or practice of a profession, including emergency or other medical services personnel. See Idaho Code 39-4502
  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
  • Qualified nursing education debt: means a debt with a financial aid program or financial institution incurred to meet the educational costs of attending an accredited nursing school. See Idaho Code 39-2502
  • Quorum: The number of legislators that must be present to do business.
  • RCRA: means the resource conservation and recovery act of 1976 as amended from time to time. See Idaho Code 39-4403
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • Recipient: means an individual who receives a grant pursuant to this chapter. See Idaho Code 39-2502
  • Recourse: An arrangement in which a bank retains, in form or in substance, any credit risk directly or indirectly associated with an asset it has sold (in accordance with generally accepted accounting principles) that exceeds a pro rata share of the bank's claim on the asset. If a bank has no claim on an asset it has sold, then the retention of any credit risk is recourse. Source: FDIC
  • Recreational vehicle: means a vehicular type unit primarily designed as temporary living quarters for recreational, camping, or travel use, which either has its own motive power or is mounted on or drawn by another vehicle. See Idaho Code 39-4201
  • Registered mail: includes certified mail. See Idaho Code 73-114
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Representative of the department: means an employee of the department. See Idaho Code 39-3502
  • Rescission: The cancellation of budget authority previously provided by Congress. The Impoundment Control Act of 1974 specifies that the President may propose to Congress that funds be rescinded. If both Houses have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation.
  • Resident: means an adult who lives in a residential care or assisted living facility. See Idaho Code 39-3302
  • Resident: means an adult who lives in a certified family home and who requires personal assistance or supervision. See Idaho Code 39-3502
  • Residential care or assisted living facility: means a facility or residence, however named, operated on either a profit or nonprofit basis for the purpose of providing necessary supervision, personal assistance, meals and lodging to three (3) or more adults not related to the owner. See Idaho Code 39-3302
  • Restricted hazardous waste: means a waste or combination of wastes regulated as land disposal restricted pursuant to federal statutes and regulations, including 40 C. See Idaho Code 39-4403
  • Room and board: means lodging and meals. See Idaho Code 39-3502
  • Rural nurse: means a licensed nurse who spends a minimum of thirty-two (32) hours per week, on average, providing nursing care to patients in an eligible area. See Idaho Code 39-2502
  • seal: includes an impression of such seal upon the paper, alone, as well as upon wax or a wafer affixed thereto; or, alternatively, the seal may be the mark of a rubber stamp providing substantially the same information as the impression. See Idaho Code 73-111
  • Service of process: The service of writs or summonses to the appropriate party.
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • Special fireworks: means any fireworks designed primarily for display and classified as special fireworks by the United States bureau of explosives or designated as UN 0335 1. See Idaho Code 39-2602
  • State: when applied to the different parts of the United States, includes the District of Columbia and the territories; and the words "United States" may include the District of Columbia and territories. See Idaho Code 73-114
  • Statute: A law passed by a legislature.
  • Storage: means the containment of hazardous wastes, on a temporary basis or for a period of years, in such a manner as not to constitute disposal of such hazardous wastes. See Idaho Code 39-4403
  • Subpoena: A command to a witness to appear and give testimony.
  • Substantial compliance: means a facility has no core issue deficiencies. See Idaho Code 39-3302
  • Substantial compliance: means a certified family home has no core issue deficiencies. See Idaho Code 39-3502

  • Summons: Another word for subpoena used by the criminal justice system.
  • Supervision: means administrative activity which provides the following: protection, guidance, knowledge of the resident’s general whereabouts, and assistance with activities of daily living. See Idaho Code 39-3302

  • Supportive services: means the specific services that are provided to the resident in the community. See Idaho Code 39-3302

  • Surrogate decision-maker: means the person authorized to consent to or refuse health care services for another person as specified in section 39-4504(1), Idaho Code. See Idaho Code 39-4502
  • Telecommunications facilities: means all wires, cables, equipment, apparatus or other installations necessary to furnish service, by which there is accomplished or may be accomplished the sending or receiving of information, data, message writing signs, signals, pictures, and sounds of all kinds, by aid of such wires, cables, equipment, apparatus or other installations, but shall not include the habitable structure in which such telecommunications facilities are housed. See Idaho Code 39-4105
  • Testify: Answer questions in court.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
  • Transportation: means the movement of any hazardous waste to or from a hazardous waste facility or site. See Idaho Code 39-4403
  • Transporter: means any person who transports a hazardous waste to or from a hazardous waste facility or site. See Idaho Code 39-4403
  • Travel trailer: means a vehicular unit, mounted on wheels, designed to provide temporary living quarters for recreational, camping or travel use, of such size or weight as not to require special highway movement permits when towed by a motorized vehicle, and of gross trailer area less than three hundred twenty (320) square feet. See Idaho Code 39-4201
  • Treatment: means any method, technique, or process, including neutralization, which is designed not to be an integral part of a production process, but which is rather designed to change the physical, chemical, or biological character or composition of any hazardous waste prior to storage or final disposal so as to neutralize such waste or so as to render such waste nonhazardous or less hazardous; safer to transport, store, or dispose of; or amenable for recovery, amenable for storage or reduced in volume. See Idaho Code 39-4403
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Truck camper: means a portable unit constructed to provide temporary living quarters for recreational, camping or travel use, consisting of a roof, floor and sides, designed to be loaded onto and unloaded from the bed of a pickup truck. See Idaho Code 39-4201
  • Trustee: A person or institution holding and administering property in trust.
  • Uniform Commercial Code: A set of statutes enacted by the various states to provide consistency among the states' commercial laws. It includes negotiable instruments, sales, stock transfers, trust and warehouse receipts, and bills of lading. Source: OCC
  • Vermin: means small animals, including insects, of public health and welfare concern which are difficult to control when they appear in large numbers. See Idaho Code 39-2801
  • Waste: means any solid, semisolid, liquid or contained gaseous material for which no reasonable use or reuse is intended or which is intended to be discarded. See Idaho Code 39-4403
  • Wholesale: means sale of fireworks to a retailer or wholesaler. See Idaho Code 39-2602
