- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
The Secretary may summarily suspend the license of a licensed behavior analyst or assistant behavior analyst without a hearing simultaneously with the institution of proceedings for a hearing provided for in this Act if the Secretary finds that evidence in the Secretary’s possession indicates that a licensee’s continuation in practice would constitute an imminent danger to the public. If the Secretary summarily suspends the license without a hearing, a hearing by the Board or Department shall be held within 30 calendar days after the suspension has occurred.
