- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Plaintiff: The person who files the complaint in a civil lawsuit.
If the plaintiff voluntarily dismisses the action, or fails to prove the plaintiff’s right to the possession, judgment for costs shall be entered in favor of the defendant.
