Other limitations on consent requirements. The consent requirements under Section 5 may not be required for the use or disclosure (as those terms are defined under HIPAA, as specified in 45 C.F.R. § 160.103) of a record or communication disclosed (as that term is defined under HIPAA, as specified in 45 C.F.R. § 160.103) to or through an HIE for HIE purposes and in accordance with this Act.
