- individual: shall include every infant member of the species homo sapiens who is born alive at any stage of development. See Illinois Compiled Statutes 5 ILCS 70/1.36
If an individual consents in a writing to be a parent of any child born of his or her gametes posthumously, and dies before the insemination of the individual’s gametes or embryo transfer, the deceased individual is a parent of any resulting child born within 36 months of the death of the deceased individual.
