Sec. 6. Subject to the restrictions under this chapter, the agency may use money in the fund to provide financial assistance under section 5(a)(1) of this chapter to an eligible entity that:
(2) is located in a jurisdiction that:
(1) has incurred a loss or response cost;

- disaster: has the meaning set forth in IC 10-14-3-1. See Indiana Code 10-14-4-1
- eligible entity: means a county, a city, a town, a township, or an individual who has incurred loss or cost because of a disaster. See Indiana Code 10-14-4-2
- fund: refers to the state disaster relief fund established by this chapter. See Indiana Code 10-14-4-3
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
(A) has declared a local disaster emergency;
(B) requires state assistance to supplement local resources to effectively respond to the disaster; and
(C) contains territory for which a disaster emergency has been declared by the governor, if the eligible entity is not an individual;
(3) has applied to the agency for financial assistance in the form of a grant; and
(4) complies with all other requirements established by the agency.
