Sec. 16. (a) An operator shall, not later than September 1 of each year, provide each resident of a housing with services establishment information concerning influenza, including the following:

(1) The means by which influenza is spread.

Terms Used In Indiana Code 12-10-15-16

  • housing with services establishment: means an establishment providing sleeping accommodations to at least five (5) residents and offering or providing for a fee:

    Indiana Code 12-10-15-3

  • operator: means a person that operates a housing with services establishment. See Indiana Code 12-10-15-4
  • resident: means an individual who has a contract to reside in a housing with services establishment. See Indiana Code 12-10-15-5
  • Year: means a calendar year, unless otherwise expressed. See Indiana Code 1-1-4-5
(2) The causes and symptoms of influenza.

(3) Risks associated with influenza.

(4) The most recent influenza vaccination recommendations of the Advisory Committee on Immunization Practices of the Centers for Disease Control and Prevention.

(5) The availability, effectiveness, and contraindications of an influenza vaccination.

     (b) This section does not require an operator to provide or pay for an influenza vaccination.

     (c) An operator is deemed to be in compliance with the requirements of this section if the operator provides a resident the latest vaccination information statement concerning influenza vaccinations issued by the Centers for Disease Control and Prevention.
