(1) neglects, when the person has a duty of care;

Under the Indiana Code, punishments for crimes depend on the classification. In the case of this section:Class | Prison | Fine |
---|---|---|
Class B misdemeanor | up to 180 days | up to $1,000 |
(2) abuses; or
(3) maltreats;
an individual with a mental illness or an individual with a developmental disability under the care of a state institution commits a Class B misdemeanor.
