Sec. 5. (a) The department shall
contract annually with an appropriate nonprofit organization to use fifty percent (50%) of the revenue credited to the special account under section 4 of this chapter for development of waterfowl propagation areas. Before paying the revenue to a nonprofit
corporation developing waterfowl areas, the department must obtain
evidence that the project is acceptable to the appropriate agency having
jurisdiction over the land and water affected by the project.

(b) The department shall spend fifty percent (50%) of the revenue credited to the special account under section 4 of this chapter:
(1) for the acquisition or development of wetlands in Indiana; or
(2) to participate in the joint funding of North American waterfowl management plans.
