Sec. 5. The department may, upon the receipt of a request in writing from:

(1) the circuit or superior court or the board of county commissioners having jurisdiction of the case;

Terms Used In Indiana Code 14-27-1-5

  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • in writing: include printing, lithographing, or other mode of representing words and letters. See Indiana Code 1-1-4-5
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
