Sec. 36. (a) Each person whose name appears on the label as distributing agricultural or vegetable seed subject to this chapter shall do the following:

(1) Keep for two (2) years complete records of each lot of agricultural or vegetable seed distributed.

Terms Used In Indiana Code 15-15-1-36

  • label: means the display or displays of written, printed, or graphic matter on or attached to a seed container or accompanying seed sold in bulk quantities. See Indiana Code 15-15-1-10
  • lot: means a definite quantity of seed identified by a lot number or other mark, every portion or bag of which is uniform within recognized tolerances for the factors that appear in the labeling. See Indiana Code 15-15-1-13
  • person: means an individual, a partnership, a company, or a corporation. See Indiana Code 15-15-1-16
  • vegetable seed: means the seeds:

  • Year: means a calendar year, unless otherwise expressed. See Indiana Code 1-1-4-5
(2) Keep for one (1) year a file sample of each lot of seed that is distributed after final disposition of the lot.

     (b) All records and samples relating to the shipments involved must be accessible for inspection by the state seed commissioner or the state seed commissioner’s agent during customary business hours.
