Sec. 5. If:
(2) a motion to terminate an injunction is made or resisted in bad faith; or
(1) a claim of misappropriation is made in bad faith;
Terms Used In Indiana Code 24-2-3-5
- Attorney: includes a counselor or other person authorized to appear and represent a party in an action or special proceeding. See Indiana Code 1-1-4-5
- Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
- Misappropriation: means :
Indiana Code 24-2-3-2
(3) willful and malicious misappropriation exists;
the court may award reasonable attorney‘s fees to the prevailing party.
