Sec. 11. A person who violates this chapter commits:

(1) a Class B misdemeanor on the first violation;

Under the Indiana Code, punishments for crimes depend on the classification. In the case of this section:Class | Prison | Fine |
---|---|---|
Level 6 felony | between 6 mos. and 2 1/2 years | up to $10,000 |
Class A misdemeanor | up to 1 year | up to $5,000 |
Class B misdemeanor | up to 180 days | up to $1,000 |
(2) a Class A misdemeanor on the second violation; and
(3) a Level 6 felony on the third and any subsequent violation.
