Sec. 2. (a) A homeowner may bring an action against a person for damages incurred as a result of a violation of this article.

Terms Used In Indiana Code 24-5.5-6-2

  • Attorney: includes a counselor or other person authorized to appear and represent a party in an action or special proceeding. See Indiana Code 1-1-4-5
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
     (b) A homeowner who:

(1) brings an action under this section; and

(2) is awarded damages;

may seek reasonable attorney‘s fees.
