Sec. 10. An insurer that:
(2) does not satisfy this requirement; and
(1) is subject to the requirement set forth in section 8(c) of this chapter with respect to the repair of a motor vehicle;
Terms Used In Indiana Code 27-4-1.5-10
- body shop: means a business that repairs damage to the exterior of motor vehicles. See Indiana Code 27-4-1.5-2
- insurer: has the meaning set forth in IC 27-1-2-3. See Indiana Code 27-4-1.5-4
- motor vehicle: has the meaning set forth in IC 9-13-2-105. See Indiana Code 27-4-1.5-5
- Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
(3) directs a body shop to repair the motor vehicle;
commits an unfair claims settlement practice under IC 27-4-1-4.5.
