Sec. 2. “Acting as a fiduciary” means undertaking to act primarily for the benefit of another. The term includes the following:

(1) Acting alone and jointly with others.

Terms Used In Indiana Code 28-14-1-2

  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Trustee: A person or institution holding and administering property in trust.
(2) Acting:

(A) as a trustee;

(B) as a personal representative;

(C) as a registrar of stocks and bonds;

(D) as a guardian or conservator of estates;

(E) as an assignee;

(F) as a receiver;

(G) as a custodian;

(H) as an investment manager or agent;

(I) as a managing agent; or

(J) as in any other, similar capacity.
