Sec. 8. (a) Upon the filing of a petition for a contest, the circuit court
clerk shall notify the circuit court judge. The judge shall issue a notice to the county
sheriff directing the sheriff to serve notice upon the contestee and all other persons named in the petition as candidates for nomination or election to the office to appear and
answer the petition in the circuit court on a day to be fixed in the notice.

Terms Used In Indiana Code 3-12-8-8
- Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
- Attorney: includes a counselor or other person authorized to appear and represent a party in an action or special proceeding. See Indiana Code 1-1-4-5
- Clerk: means the clerk of the court or a person authorized to perform the clerk's duties. See Indiana Code 1-1-4-5
- Sheriff: means the sheriff of the county or another person authorized to perform sheriff's duties. See Indiana Code 1-1-4-5
(1) the county election board; and
(2) the election division if the petition relates to a contest for the office of judge or prosecuting attorney.
