Terms Used In Indiana Code 31-32-6-7

  • Bench trial: Trial without a jury in which a judge decides the facts.
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
     (b) A trial of an adult charged with a crime shall be tried to a jury unless:

(1) the adult requests a bench trial; or

(2) the adult waives the right to a jury trial under the Indiana Rules of Criminal Procedure.
