Terms Used In Indiana Code 34-25.5-4-2

  • Pleadings: Written statements of the parties in a civil case of their positions. In the federal courts, the principal pleadings are the complaint and the answer.
  • Verified: when applied to pleadings, means supported by oath or affirmation in writing. See Indiana Code 1-1-4-5
(2) allege any new matter in avoidance.

The new matter must be verified except in cases of commitment on a criminal charge. The return and pleadings may be amended without causing any delay.
