Sec. 13. Money that is:
(2) remains in the hands of the collecting officer;
(1) collected upon a judgment that is later enjoined; and
Terms Used In Indiana Code 34-26-1-13
- Clerk: means the clerk of the court or a person authorized to perform the clerk's duties. See Indiana Code 1-1-4-5
- Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
- Judgment: means all final orders, decrees, and determinations in an action and all orders upon which executions may issue. See Indiana Code 1-1-4-5
shall be paid to the clerk of the court granting the injunction, subject to the order of the court.
