Sec. 3. As used in this chapter, “optional equipment” means equipment or a component part of a commercial motor vehicle that:

(1) was not required to be installed or equipped on the commercial motor vehicle under 49 C.F.R. part 571 (Federal Motor Vehicle Safety Standards) at the time the commercial motor vehicle was manufactured or first sold, whichever is later; and

Terms Used In Indiana Code 34-30-35-3

  • commercial motor vehicle: means a motor vehicle that is used for commercial purposes in interstate or intrastate commerce to transport property or passengers, deliver or transport goods, or provide services. See Indiana Code 34-30-35-2
(2) was not required to be installed or equipped on the commercial motor vehicle by a law or regulation issued after the commercial motor vehicle was manufactured or first sold.
