Sec. 10.5. (a) A person less than twenty-one (21) years of age who:

(1) purchases tobacco, an e-liquid, or an electronic cigarette;

Terms Used In Indiana Code 35-46-1-10.5

  • e-liquid: has the meaning set forth in Indiana Code 35-46-1-1.4
  • electronic cigarette: means a device that is capable of providing an inhalable dose of nicotine by delivering a vaporized solution. See Indiana Code 35-46-1-1.5
  • tobacco: includes :

    Indiana Code 35-46-1-1.7

(2) accepts tobacco, an e-liquid, or an electronic cigarette for personal use; or

(3) possesses tobacco, an e-liquid, or an electronic cigarette on the person’s person;

commits a Class C infraction.

     (b) It is a defense under subsection (a) that the accused person acted in the ordinary course of employment in a business concerning tobacco, an e-liquid, or an electronic cigarette for the following activities:

(1) Agriculture.

(2) Processing.

(3) Transporting.

(4) Wholesaling.

(5) Retailing.
