Sec. 5. (a) As used in this section, “preexisting condition exclusion” has the meaning set forth in 45 C.F.R. § 144.103, as in effect on January 1, 2019.

  • Patient Protection and Affordable Care Act: refers to the federal Patient Protection and Affordable Care Act (P. See Indiana Code 4-1-12-1
     (b) Notwithstanding any other law:

(1) 42 U.S.C. §§ 300gg-3;

(2) 45 C.F.R. § 147.108; and

(3) all other provisions of the Patient Protection and Affordable Care Act concerning preexisting condition exclusions;

and the protections therein and in effect on January 1, 2019, are in effect and must be enforced in Indiana, regardless of the legal status of the Patient Protection and Affordable Care Act.
