Sec. 6. (a) The following individuals may not wager on gambling games at a facility licensed under this article:

- Conviction: A judgement of guilt against a criminal defendant.
(3) The spouse of any individual listed in subdivisions (1) and (2).
(b) A person who knowingly or intentionally violates this section commits a Class C infraction. However, the violation is a Class A misdemeanor if the person has a prior unrelated adjudication or conviction for a violation of this section within the previous five (5) years.
