Terms Used In Indiana Code 4-7-1-8

  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
   Sec. 8. A copy of the account, in a case made out and certified by the state comptroller, shall be sufficient evidence to support an action for the amount stated to be due, without proof of the signature or official character of the state comptroller, subject to the right of the defendant to plead and give in evidence, as in other actions, all matters as shall be legal and proper for the defendant’s defense.
