Terms Used In Indiana Code 8-1-28-10

  • Clean Water Act: refers to the Federal Water Pollution Control Act (Indiana Code 8-1-28-1
  • commission: refers to the Indiana utility regulatory commission. See Indiana Code 8-1-1-1
  • environmental compliance plan: means a plan developed by a public utility to comply in whole or in part with the requirements of the Safe Drinking Water Act or the Clean Water Act. See Indiana Code 8-1-28-2
  • public utility: means a public utility, a municipally owned utility, or a cooperatively owned utility. See Indiana Code 8-1-28-3
  • Safe Drinking Water Act: refers to the federal Safe Drinking Water Act (Public Health Service Act, Indiana Code 8-1-28-4
(2) because of action by a federal or state government environmental agency, is required to;

modify a portion of an environmental compliance plan that has previously been approved by the commission in order to comply with the requirements of the Safe Drinking Water Act or Clean Water Act, the public utility shall submit a modified environmental compliance plan to the commission for the commission’s review. The conflict provisions of section 9 of this chapter apply to a modified environmental compliance plan submitted under this section.
