Sec. 4. As used in this chapter, “new electric transmission owner” means a
corporation, company,
partnership, limited liability company, or other organization that:
(1) on the date of its incorporation or organization, does not own, operate, or maintain an electric transmission facility located in whole or in part in Indiana; and

Terms Used In Indiana Code 8-1-38-4
- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- electric transmission facility: means a high voltage transmission line with a rating of at least one hundred (100) kilovolts and related transmission facilities and controls. See Indiana Code 8-1-38-1
- Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
(2) is incorporated or organized to construct, own, operate, and maintain an electric transmission facility located in whole or in part in Indiana.
