  • active ingredient: means :

  • adulterated: refers to a pesticide or pesticide product if:

    Indiana Code 15-16-4-3

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • aquatic ecologist: means a scientist with a degree in, extensive training in, or experience in at least one (1) of the following:

  • Attorney: includes a counselor or other person authorized to appear and represent a party in an action or special proceeding. See Indiana Code 1-1-4-5
  • board: means the Indiana pesticide review board established by section 42 of this chapter. See Indiana Code 15-16-4-6
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • defoliant: means any:

  • desiccant: means any:

  • device: means any instrument or contrivance intended for trapping, destroying, repelling, or mitigating any pest. See Indiana Code 15-16-4-10
  • distribute: means to:

  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Ex officio: Literally, by virtue of one's office.
  • Fiduciary: A trustee, executor, or administrator.
  • fungicide: means any substance or mixture of substances intended for:

  • general use pesticide: means a pesticide that is not a restricted use pesticide. See Indiana Code 15-16-4-15.5
  • herbicide: means any substance or mixture of substances intended for:

  • immediate container: means the part of a container that is in direct contact with a pesticide. See Indiana Code 15-16-4-18
  • in writing: include printing, lithographing, or other mode of representing words and letters. See Indiana Code 1-1-4-5
  • ingredient statement: means any of the following:

  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • insecticide: means any substance or mixture of substances intended for:

  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • label: means :

  • labeling: means all labels and other written, printed, or graphic matter:

  • material damage: means any:

  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.

  • pest: has the meaning set forth in IC 15-16-5-24. See Indiana Code 15-16-4-29
  • pesticide: means :

  • pesticide formulation: means a pesticide product comprised of all active ingredients and inert ingredients. See Indiana Code 15-16-4-32
  • pesticide product: means a pesticide or device offered for distribution or use, including any labeling. See Indiana Code 15-16-4-33
  • plant regulator: means any substance or mixture of substances, intended through physiological action, for:

    Indiana Code 15-16-4-34

  • produce: means :

    Indiana Code 15-16-4-35

  • Quorum: The number of legislators that must be present to do business.
  • registrant: means a person who registers a pesticide product under this chapter. See Indiana Code 15-16-4-36
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • restricted use pesticide: means the following:

  • rodenticide: means any substance or mixture of substances intended for:

  • Subpoena: A command to a witness to appear and give testimony.
  • terrestrial ecologist: means a scientist with a degree in, extensive training in, or experience in at least one (1) of the following:

  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
  • United States: includes the District of Columbia and the commonwealths, possessions, states in free association with the United States, and the territories. See Indiana Code 1-1-4-5
  • weed: means any plant that grows where the plant is not wanted. See Indiana Code 15-16-4-40
  • wildlife: has the meaning set forth in IC 15-16-5-38. See Indiana Code 15-16-4-41
  • Year: means a calendar year, unless otherwise expressed. See Indiana Code 1-1-4-5
