  • access practice agreement: means an agreement that:

  • access practice dentist: means a licensed dentist who is licensed under IC 25-14 and has entered into an access practice agreement under this chapter with a dental hygienist. See Indiana Code 25-13-3-3
  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Agency: refers to the Indiana professional licensing agency under IC 25-1-5. See Indiana Code 25-10-1-1
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • approved organization: means the following:

  • Attorney: includes a counselor or other person authorized to appear and represent a party in an action or special proceeding. See Indiana Code 1-1-4-5
  • Board: means the state board of dentistry established by IC 25-14-1. See Indiana Code 25-13-1-2

  • Chiropractic: means the examination, diagnosis, evaluation, and treatment of human ailments and conditions of any interference with normal nerve transmission and expression, the procedure preparatory to and complementary to the correction thereof by an adjustment or manipulation of the articulations of the vertebral column, its immediate articulation, including other incidental means of adjustments of the spinal column, extremities, and musculoskeletal soft tissues of the body without the use of prescription drugs or surgery.   • chiropractic management consultant: means any person doing business in Indiana for the purpose of offering consulting services to chiropractors regarding the administration and operation of their practice. See Indiana Code 25-10-2-1
  • Chiropractor: means any person who is qualified under this chapter to practice the science of chiropractic. See Indiana Code 25-10-1-1
  • committee: means the dental recruitment committee established by section 4 of this chapter. See Indiana Code 25-14-5-1
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Continuance: Putting off of a hearing ot trial until a later time.
  • continuing education course: means an orderly process of instruction designed to directly enhance the practicing dentist's knowledge and skill in providing relevant dentist services that is approved by an approved organization. See Indiana Code 25-14-3-4
  • continuing education course: means an orderly process of instruction designed to directly enhance the practicing dental hygienist's knowledge and skill in providing relevant dental hygiene services that is approved by an approved organization. See Indiana Code 25-13-2-3
  • Contract: A legal written agreement that becomes binding when signed.
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Dental hygienist: means one who is especially educated and trained in the science and art of maintaining the dental health of the individual or community through prophylactic or preventive measures applied to the teeth and adjacent structures. See Indiana Code 25-13-1-2
  • dentist: means an individual who holds a license to practice dentistry in Indiana issued under IC 25-14-1. See Indiana Code 25-14-2-1
  • Dependent: A person dependent for support upon another.
  • Direct supervision: means that a licensed dentist is physically present in the facility when patient care is provided by the dental hygienist. See Indiana Code 25-13-1-2
  • Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
  • Employer dentist: means a proprietor dentist who employs at least one (1) dental hygienist to supplement the proprietor dentist's dental service to the proprietor dentist's clientele. See Indiana Code 25-13-1-2
  • Escrow: Money given to a third party to be held for payment until certain conditions are met.
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Fraud: Intentional deception resulting in injury to another.
  • fund: refers to the Indiana dental recruitment fund established by section 5 of this chapter. See Indiana Code 25-14-5-2
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • in writing: include printing, lithographing, or other mode of representing words and letters. See Indiana Code 1-1-4-5
  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Judgment: means all final orders, decrees, and determinations in an action and all orders upon which executions may issue. See Indiana Code 1-1-4-5
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Jurisprudence: The study of law and the structure of the legal system.
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • License: means the license to practice dental hygiene issued by the state board of dentistry to dental hygienist candidates who satisfactorily pass the board's examinations. See Indiana Code 25-13-1-2
  • license: means a license to practice dentistry under IC 25-14-1-3. See Indiana Code 25-14-3-5
  • license period: means the two (2) year period beginning on March 2, 1992, and every two (2) years thereafter. See Indiana Code 25-13-2-4

  • Licensed dentist: refers to a dentist licensed under IC 25-14. See Indiana Code 25-13-1-2

  • Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Population: has the meaning set forth in Indiana Code 1-1-4-5
  • Prescriptive supervision: means that a licensed dentist is not required to be physically present in the facility when patient care is provided by the dental hygienist if:

  • President pro tempore: A constitutionally recognized officer of the Senate who presides over the chamber in the absence of the Vice President. The President Pro Tempore (or, "president for a time") is elected by the Senate and is, by custom, the Senator of the majority party with the longest record of continuous service.
  • Probate: Proving a will
  • Proprietor dentist: means a licensed dentist who is the owner and operator of the dental office in which the licensed dentist practices the profession of dentistry and who employs at least one (1) licensed dentist or dental hygienist to supplement the licensed dentist's operation and conduct of the licensed dentist's dental office. See Indiana Code 25-13-1-2
  • Public health setting: means a location, including a mobile health care vehicle, where the public is invited for health care, information, and services by a program sponsored or endorsed by a governmental entity or charitable organization. See Indiana Code 25-13-1-2
  • Quorum: The number of legislators that must be present to do business.
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Screening: means to identify and assess the health of the hard or soft tissues of the human oral cavity. See Indiana Code 25-13-1-2
  • Statute: A law passed by a legislature.
  • study club: means a group of at least five (5) dentists who do the following:

  • tanning device: means equipment that meets the following conditions:

  • tanning facility: means a facility that provides persons with access to a tanning device. See Indiana Code 25-8-15.4-4
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
  • Trustee: A person or institution holding and administering property in trust.
  • underserved area: means a county, city, town, census tract, or township designated by the Indiana department of health under IC 16-46-5-7 or by the committee as underserved by general dentists, pediatric dentists, oral surgeons, or dental hygienists. See Indiana Code 25-14-5-3
  • United States: includes the District of Columbia and the commonwealths, possessions, states in free association with the United States, and the territories. See Indiana Code 1-1-4-5
  • Year: means a calendar year, unless otherwise expressed. See Indiana Code 1-1-4-5
