Terms Used In Indiana Code > Title 8 > Article 14 - Highway Finances

  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Arterial road system: shall mean the system of roads including bridges in each county of Indiana, under the jurisdiction of the board of county commissioners, or successor body, including a department of transportation of a consolidated city, designated as such by the board under IC 8-23-4-3, but not including local county roads. See Indiana Code 8-14-2-1
  • Arterial street system: means the system of streets, including bridges in each city or town in Indiana, under the jurisdiction of municipal street authorities or successor bodies, including a department of transportation of a consolidated city, designated as such by the board under IC 8-23-4-4, but not including local streets. See Indiana Code 8-14-2-1
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Attorney: includes a counselor or other person authorized to appear and represent a party in an action or special proceeding. See Indiana Code 1-1-4-5
  • authority: refers to the Indiana finance authority established by Indiana Code 8-14-17-1
  • authority: refers to the Indiana finance authority. See Indiana Code 8-14-15.2-1
  • authority: refers to the Indiana finance authority. See Indiana Code 8-14-15.1-1
  • authority: refers to the Indiana finance authority established by Indiana Code 8-14-14-1
  • board: refers to the local bridge grant board established by section 9 of this chapter. See Indiana Code 8-14-11-1
  • board: refers to the next level Indiana fund investment board established by section 7 of this chapter. See Indiana Code 8-14-15.1-2
  • Caucus: From the Algonquian Indian language, a caucus meant "to meet together." An informal organization of members of the legislature that exists to discuss issues of mutual concern and possibly to perform legislative research and policy planning for its members. There are regional, political or ideological, ethnic, and economic-based caucuses.
  • construction: means the building of a local bridge to the extent that new, supplementary, or substantially improved traffic service is provided. See Indiana Code 8-14-11-2
  • construction: shall mean both construction and reconstruction to a degree that new, supplementary, or substantially improved traffic service is provided, and significant geometric or structural improvements are effected. See Indiana Code 8-14-2-1
  • construction: means the planning, supervising, inspecting, actual building, draining, and all expenses incidental to the construction of a highway. See Indiana Code 8-14-1-1
  • Contract: A legal written agreement that becomes binding when signed.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • department: refers to the Indiana department of transportation. See Indiana Code 8-14-11-3
  • department: refers to the Indiana department of transportation. See Indiana Code 8-14-17-2

  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
  • Escrow: Money given to a third party to be held for payment until certain conditions are met.
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • executive: has the meaning set forth in IC 36-1-2-5. See Indiana Code 8-14-11-4
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • fund: refers to the major moves 2020 trust fund established by section 3 of this chapter. See Indiana Code 8-14-14.1-2
  • fund: refers to the major moves construction fund established by section 5 of this chapter. See Indiana Code 8-14-14-3
  • fund: refers to the local bridge grant fund established by section 8 of this chapter. See Indiana Code 8-14-11-5
  • fund: refers to a local major moves construction fund established under section 4 of this chapter. See Indiana Code 8-14-16-2
  • fund: refers to the alternative transportation construction fund established by section 4 of this chapter. See Indiana Code 8-14-17-3
  • fund: refers to the state highway road construction and improvement fund. See Indiana Code 8-14-10-2
  • grant: refers to a historic bridge maintenance grant under this chapter. See Indiana Code 8-14-12-1
  • Highway: includes county bridges and state and county roads, unless otherwise expressly provided. See Indiana Code 1-1-4-5
  • highways: includes roadway, rights of way, bridges, drainage structures, signs, guard rails, protective structures in connection with highways, drains, culverts, and bridges and the substructure and superstructure of bridges and approaches thereto and streets and alleys of cities or towns. See Indiana Code 8-14-1-1
  • historic bridge: means a bridge that meets the following requirements:

  • in writing: include printing, lithographing, or other mode of representing words and letters. See Indiana Code 1-1-4-5
  • Irrevocable trust: A trust arrangement that cannot be revoked, rescinded, or repealed by the grantor.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • local bridge: means a structure that:

  • Local county roads: shall mean all county roads and bridges which are not designated as being in the arterial road system. See Indiana Code 8-14-2-1
  • Local streets: shall mean all city and town streets and bridges which are not designated as being in the arterial street system in each city or town. See Indiana Code 8-14-2-1
  • maintenance: when used in reference to cities, towns, and counties as applied to that part of the highway other than bridges, means the constant making of needed repairs, to preserve a smooth surfaced highway, adequately drained, marked and guarded by protective structures for public safety and, as to bridges, means the constant making of needed repairs to preserve a smooth surfaced highway thereon and the safety and preservation of the bridge and its approaches, together with the substructure and superstructure thereof; and such term also means and includes the acquisition and use, in any manner, of all needed equipment, fuel, materials, and supplies essential and incident thereto.   • Month: means a calendar month, unless otherwise expressed. See Indiana Code 1-1-4-5
  • Motor vehicle highway account: means the account of the general fund of the state known as the "motor vehicle highway account" to which is credited collections from motor vehicle registration fees, licenses, driver's and chauffeur's license fees, gasoline taxes, auto transfer fees, certificate of title fees, weight taxes or excise taxes and all other similar special taxes, duties or excises of all kinds on motor vehicles, trailers, motor vehicle fuel, or motor vehicle owners or operators.   • National Bank: A bank that is subject to the supervision of the Comptroller of the Currency. The Office of the Comptroller of the Currency is a bureau of the U.S. Treasury Department. A national bank can be recognized because it must have "national" or "national association" in its name. Source: OCC
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Population: has the meaning set forth in Indiana Code 1-1-4-5
  • preservation: means the preventative treatment, nonstructural treatment, rehabilitation, or structural repairs made to transportation infrastructure and related drainage that are included in an asset management plan approved by the Indiana department of transportation in collaboration with the local technical assistance program at Purdue University. See Indiana Code 8-14-1-1
  • President pro tempore: A constitutionally recognized officer of the Senate who presides over the chamber in the absence of the Vice President. The President Pro Tempore (or, "president for a time") is elected by the Senate and is, by custom, the Senator of the majority party with the longest record of continuous service.
  • principal of the trust: means an amount equal to two hundred fifty million dollars ($250,000,000). See Indiana Code 8-14-15.2-2
  • Property: includes personal and real property. See Indiana Code 1-1-4-5
  • Quorum: The number of legislators that must be present to do business.
  • reconstruction: includes the improvement, enlargement, or extension of a highway, but does not include maintenance or repairs. See Indiana Code 8-14-10-3
  • reconstruction: includes the resurfacing and rebuilding of a local bridge to the extent that significant structural improvements result. See Indiana Code 8-14-11-7
  • reconstruction: means a widening or a rebuilding of the highway or any portion thereof. See Indiana Code 8-14-1-1
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Resurfacing: means the placement of additional pavement layers (including protective systems for bridge decks) over the existing (or restored or rehabilitated) roadway or bridge deck surface to provide additional strength or to improve serviceability for a substantial time period. See Indiana Code 8-14-2-1
  • state highway: means any highway that is designated as part of the state highway system under IC 8-23-4. See Indiana Code 8-14-10-4
  • Statute: A law passed by a legislature.
  • transportation plan: refers to the department's long range comprehensive transportation plan developed under IC 8-23-2-5. See Indiana Code 8-14-14-4
  • trust: refers to the next level Indiana trust fund established under section 5 this chapter. See Indiana Code 8-14-15.1-3
  • trust: refers to the next generation trust fund established under this chapter. See Indiana Code 8-14-15.2-3
  • trustee: refers to the trustee of the trust designated under sections 7 and 9 of this chapter. See Indiana Code 8-14-15.1-4
  • trustee: refers to the trustee of the trust designated under section 8 of this chapter. See Indiana Code 8-14-15.2-4
  • Trustee: A person or institution holding and administering property in trust.
  • United States: includes the District of Columbia and the commonwealths, possessions, states in free association with the United States, and the territories. See Indiana Code 1-1-4-5
  • User fees: Fees charged to users of goods or services provided by the government. In levying or authorizing these fees, the legislature determines whether the revenue should go into the treasury or should be available to the agency providing the goods or services.
  • vehicle registration: means the number of vehicles subject to registration under IC 9-18 (before January 1, 2017) or Indiana Code 8-14-1-1
  • Year: means a calendar year, unless otherwise expressed. See Indiana Code 1-1-4-5
