1. Following a review of an applicant‘s or recipient‘s eligibility under this chapter, the department may refer cases of suspected fraud along with any supportive information to the department of inspections, appeals, and licensing for review.
Terms Used In Iowa Code 239.9
- Applicant: means an individual who is applying for public assistance benefits in the state. See Iowa Code 239.1
- Conviction: A judgement of guilt against a criminal defendant.
- Department: means the department of health and human services. See Iowa Code 249L.2
- Department: means the department of health and human services. See Iowa Code 239.1
- Fraud: Intentional deception resulting in injury to another.
- Garnishment: Generally, garnishment is a court proceeding in which a creditor asks a court to order a third party who owes money to the debtor or otherwise holds assets belonging to the debtor to turn over to the creditor any of the debtor
- Public assistance: means the supplemental nutrition assistance program or SNAP, the Medicaid program or Medicaid as defined in section 249A. See Iowa Code 239.1
- Recipient: means an individual who is receiving public assistance benefits in the state. See Iowa Code 239.1
- state: when applied to the different parts of the United States, includes the District of Columbia and the territories, and the words "United States" may include the said district and territories. See Iowa Code 4.1
2. In cases of substantiated fraud, upon conviction, the state shall review all appropriate legal options including but not limited to removal of a recipient from other public assistance programs and garnishment of wages or state income tax refunds until the department recovers an equal amount of benefits fraudulently claimed.
3. The department may refer suspected cases of fraud, misrepresentation, or inadequate documentation relating to initial or continued eligibility to appropriate state agencies, divisions, or departments for review of eligibility issues in programs providing public benefits other than those as defined in this chapter.
