1. The owner, or person having a lien or encumbrance upon a registered vehicle which has been stolen or embezzled, may notify the department of such theft or embezzlement, but in the event of an embezzlement may make such report only after having procured the issuance of a warrant for the arrest of the person charged with such embezzlement.

Terms Used In Iowa Code 321.73

  • Arrest: Taking physical custody of a person by lawful authority.
  • Department: means the state department of transportation. See Iowa Code 321H.2
  • Embezzlement: In most states, embezzlement is defined as theft/larceny of assets (money or property) by a person in a position of trust or responsibility over those assets. Embezzlement typically occurs in the employment and corporate settings. Source: OCC
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Owner: means a person, other than a lienholder, having the property right in or title to an all-terrain vehicle. See Iowa Code 321I.1
  • Person: includes any individual, firm, corporation, partnership, joint adventure, or association, and the plural as well as the singular number. See Iowa Code 321H.2
  • Vehicle: means any vehicle as defined in chapter 321. See Iowa Code 321H.2
 2. Every owner or other person who has given any such notice must notify the department of a recovery of such vehicle.
