A petition may be filed with the auditor requesting the supervisors to dissolve an inactive district. The petition shall:
1. State that the district owns no property of any kind exclusive of records, maps, plans, and files, and that all of its debts and obligations have been fully paid.
Terms Used In Iowa Code 357A.17
- Auditor: means the county auditor of a county in which a district has been incorporated and organized or is proposed to be incorporated and organized. See Iowa Code 357A.1
- Board: means the board of directors of a district, and "director" means a member of such board of directors. See Iowa Code 357A.1
- District: means a rural water district incorporated and organized pursuant to the provisions of this chapter. See Iowa Code 357A.1
- property: includes personal and real property. See Iowa Code 4.1
- Supervisors: means the board of supervisors of a county, or the board of supervisors of an adjacent county, in which a district has been incorporated and organized or is proposed to be incorporated and organized. See Iowa Code 357A.1
- year: means twelve consecutive months. See Iowa Code 4.1
2. State that the board has not held a meeting for more than one year prior to the date of filing of the petition, that the district is not functioning, and will probably continue to be inoperative.
3. Be signed by three-fourths of the members of the district.
