For purposes of this subchapter unless the context otherwise requires, “reorganization” means either of the following:
1. The acquisition, sale, lease, or any other disposition, directly or indirectly, including by merger or consolidation, of the whole or any substantial part of a public utility‘s assets.
Terms Used In Iowa Code 476.76
- Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
- following: when used by way of reference to a chapter or other part of a statute mean the next preceding or next following chapter or other part. See Iowa Code 4.1
- Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
- public utility: shall include any person, partnership, business association, or corporation, domestic or foreign, owning or operating any facilities for:a. See Iowa Code 476.12. The purchase or other acquisition or sale or other disposition of the controlling capital stock of any public utility, either directly or indirectly.
