Terms Used In Iowa Code 543B.61

  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
543B.61 Violations — real estate commission jurisdiction.
1. Failure of a licensee to comply with sections 543B.57 through 543B.60 is prima facie
evidence of a violation under § 543B.34, subsection 1, paragraph “”d””.
2. Failure of a licensee to act in accordance with the disclosures made pursuant to sections 543B.56 through 543B.58 is prima facie evidence of a violation under section
543B.34, subsection 1, paragraph “”d””.
3. Nothing in this subchapter shall affect the validity of title to real property transferred based solely on the reason that a licensee failed to conform to the provisions of this subchapter.
