Terms Used In Iowa Code 701.13
- Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.
- Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
- person: means individual, corporation, limited liability company, government or governmental subdivision or agency, business trust, estate, trust, partnership or association, or any other legal entity. See Iowa Code 4.1
701.13 Depositions before indictment.
A person expecting to be made a party to a criminal prosecution shall not be entitled to
conduct a deposition in the criminal proceeding prior to the person being indicted for a criminal offense.
