Terms Used In Iowa Code 724.31A
- clerk: means clerk of the court in which the action or proceeding is brought or is pending; and the words "clerk's office" mean the office of that clerk. See Iowa Code 4.1
- person: means individual, corporation, limited liability company, government or governmental subdivision or agency, business trust, estate, trust, partnership or association, or any other legal entity. See Iowa Code 4.1
724.31A Identifying information — background checks.
1. When a court issues an order or judgment by which a person is prohibited from acquiring a pistol or revolver under § 724.15, subsection 2, paragraph “”d””, the clerk of the district court shall forward only such information as is necessary to identify the person to the department of public safety, which in turn shall forward the information to the federal bureau of investigation or its successor agency for the sole purpose of inclusion in the national instant criminal background check system database. The clerk of the district court shall also notify the person of the prohibitions imposed under this section.
2. The department of public safety shall, as soon as is practicable after receiving a written request from a person who is no longer prohibited from acquiring a pistol or revolver under § 724.15, subsection 2, paragraph “”d””, update, correct, modify, or remove the person’s record in any database that the department of public safety makes available to the national instant criminal background check system and shall notify the United States department of justice that the basis for such record being made available no longer applies.
