Terms Used In Iowa Code 804.2

  • Arrest: Taking physical custody of a person by lawful authority.
  • Magistrate: means a judicial officer appointed under chapter 602, article 6, part 4. See Iowa Code 4.1
  • state: when applied to the different parts of the United States, includes the District of Columbia and the territories, and the words "United States" may include the said district and territories. See Iowa Code 4.1
804.2 Contents of arrest warrant.
The warrant must be directed to any peace officer in the state; give the name of the
defendant, if known to the magistrate; if unknown, may designate “”name unknown””; and must state by name or general description an offense which authorizes a warrant to issue, the date of issuing it, the county or city where issued, and be signed by the magistrate with the magistrate’s name of office.
