Terms Used In Iowa Code > Chapter 455D - Waste Volume Reduction and Recycling

  • Alcoholic beverage: includes alcohol, wine, spirits, beer, or any other beverage which contains ethyl alcohol and is fit for human consumption. See Iowa Code 462A.2
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Certificate: means a certificate of title. See Iowa Code 462A.2
  • Commission: means the environmental protection commission. See Iowa Code 455D.1
  • Commission: means the natural resource commission. See Iowa Code 462A.2
  • Contract: A legal written agreement that becomes binding when signed.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Dealer: means a person who engages in whole or in part in the business of buying, selling, or exchanging vessels either outright or on conditional sale, bailment, lease, security interest, or otherwise, and who has an established place of business for sale, trade, and display of vessels. See Iowa Code 462A.2
  • Department: means the department of natural resources created pursuant to section 455A. See Iowa Code 455D.1
  • Department: means the department of natural resources. See Iowa Code 462A.2
  • Director: means the director of the department. See Iowa Code 455D.1
  • Director: means the director of the department or the director's designee. See Iowa Code 462A.2
  • Distributor: means a person who takes title to one or more packages or packaging components purchased for promotional purposes or resale. See Iowa Code 455D.19
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • following: when used by way of reference to a chapter or other part of a statute mean the next preceding or next following chapter or other part. See Iowa Code 4.1
  • Incidental presence: means the presence of a regulated metal as an unintended or undesired ingredient of a package or packaging component. See Iowa Code 455D.19
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Intentional introduction: means an act of deliberately utilizing a regulated metal in the formulation of a package or packaging component where its continued presence is desired in the final package or packaging component to provide a specific characteristic, appearance, or quality. See Iowa Code 455D.19
  • Manufacturer: means a person engaged in the business of manufacturing or importing new and unused vessels, or new and unused outboard motors, for the purpose of sale or trade. See Iowa Code 462A.2
  • Manufacturing: means physical or chemical modification of one or more materials to produce packaging or packaging components. See Iowa Code 455D.19
  • Operate: means to navigate or otherwise use a vessel or motorboat. See Iowa Code 462A.2
  • Operator: means a person who operates or is in actual physical control of a vessel. See Iowa Code 462A.2
  • Owner: means a person, other than a lienholder, having the property right in or title to a motorboat or vessel. See Iowa Code 462A.2
  • Package: means a container which provides a means of marketing, protecting, or handling a product including a unit package, intermediate package, or a shipping container. See Iowa Code 455D.19
  • Packaging component: means any individual assembled part of a package including but not limited to interior and exterior blocking, bracing, cushioning, weatherproofing, exterior strapping, coatings, closures, inks, labels, tin-plated steel that meets ASTM (American society for testing and materials) international specification A-623, electro-galvanized coated steel, or hot-dipped-coated galvanized steel that meets ASTM (American society for testing and materials) international specification A-525 or A-879. See Iowa Code 455D.19
  • Passenger: means a person carried on board a vessel, including the operator, and anyone towed by a vessel on water skis, surfboards, inner tubes, or similar devices. See Iowa Code 462A.2
  • Person: means an individual, partnership, firm, corporation, or association. See Iowa Code 462A.2
  • Pollution prevention techniques: means any of the following practices employed by the user of a toxic substance:
  • property: includes personal and real property. See Iowa Code 4.1
  • Recycling: includes but is not limited to the composting of yard waste which has been previously separated from other waste, but does not include any form of energy recovery. See Iowa Code 455D.1
  • Regulated metal: means any metal regulated under this section. See Iowa Code 455D.19
  • Reusable entities: means packaging or packaging components having a controlled distribution and reuse subject to the exemption provided in subsection 5, paragraph "e". See Iowa Code 455D.19
  • Rule: includes "regulation". See Iowa Code 4.1
  • state: when applied to the different parts of the United States, includes the District of Columbia and the territories, and the words "United States" may include the said district and territories. See Iowa Code 4.1
  • United States: includes all the states. See Iowa Code 4.1
  • Use: means to operate, navigate, or employ a vessel. See Iowa Code 462A.2
  • Waste reduction: means practices which reduce, avoid, or eliminate both the generation of solid waste and the use of toxic materials so as to reduce risks to health and the environment and to avoid, reduce, or eliminate the generation of wastes or environmental pollution at the source and not merely achieved by shifting a waste output or waste stream from one environmental medium to another environmental medium. See Iowa Code 455D.1
  • year: means twelve consecutive months. See Iowa Code 4.1
