Terms Used In Kansas Statutes 12-5606
- Authority: means the riverfront authority created by this act. See Kansas Statutes 12-5602
- Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
- Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
- Metropolitan area: includes the area within the corporate limits of the city of Topeka. See Kansas Statutes 12-5602
- Property: includes personal and real property. See Kansas Statutes 77-201
- Riverfront: means all real estate, equipment, rights and property useful for the purpose of recreation, along the banks of the Kansas river that runs through the city of Topeka and Shawnee county. See Kansas Statutes 12-5602
(a) Except as provided by subsection (c), the authority shall have power to acquire by purchase, lease, gift or otherwise all or any part of real property, property, rights in property, for the purpose of planning, development and creation of a riverfront within the metropolitan area as herein defined.
(b) Except as provided by subsection (c), the authority shall have power to acquire by purchase, lease, gift or otherwise any property and rights useful for its purposes and to sell, lease, transfer or convey any property or rights when no longer useful or exchange the same for other property or rights which are useful for its purposes.
(c) The authority shall not have the power to take property by eminent domain.
