Terms Used In Kansas Statutes 40-2209i
- Carrier: means an insurance company, medical or hospital service corporation, medical and hospital service corporation or health maintenance organization which holds a valid certificate of authority from the insurance commissioner. See Kansas Statutes 40-2239
- Health benefit plan: means a contract for group medical, surgical, hospital or any other remedial care recognized by state law and related services and supplies. See Kansas Statutes 40-2239
- Premium: means the monthly or other periodic charge for a health benefit plan. See Kansas Statutes 40-2239
From and after January 1, 1993: In connection with the offering for sale of any health benefit plan to a small employer, each carrier shall make a reasonable disclosure as part of its solicitation and sales materials, of:
(a) The extent to which premium rates for a specific small employer are established or adjusted in part based upon the actual or expected variation in claims costs or actual or expected variation in health condition of the employees and dependents of such small employer;
(b) the provisions concerning such carrier’s right to change premium rates and the factors other than claims experience which affect changes in premium rates; and
(c) provisions relating to renewability of policies and contracts; and
(d) the provision relating to any pre-existing condition provision.
