Kansas Statutes 40-2c10. Domestic insurer to file RBC plan in any state authorized to do business
Terms Used In Kansas Statutes 40-2c10
- Commissioner: means the commissioner of insurance. See Kansas Statutes 40-2c01
- Domestic insurer: means any insurance company or risk retention group that is licensed and organized in this state. See Kansas Statutes 40-2c01
- RBC: means risk-based capital. See Kansas Statutes 40-2c01
- RBC plan: means a comprehensive financial plan containing the elements specified in Kan. See Kansas Statutes 40-2c01
- State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See Kansas Statutes 77-201
Every domestic insurer that files an RBC plan or revised RBC plan with the commissioner shall file a copy of the RBC plan or revised RBC plan with the insurance commissioner in any state in which the insurer is authorized to do business if:
(a) Such state has an RBC provision substantially similar to Kan. Stat. Ann. § 40-2c20; and
(b) the insurance commissioner of that state has notified the insurer of such insurance commissioner’s request for the filing in writing, in which case the insurer shall file a copy of the RBC plan or revised RBC plan in that state no later than the later of:
(1) Fifteen days after the receipt of notice to file a copy of its RBC plan or revised RBC plan with the state; or
(2) the date on which the final RBC plan or revised RBC plan is filed under Kan. Stat. Ann. §§ 40-2c07 and 40-2c08.
