It shall be an affirmative defense to a violation of the truth in musical performance advertising act if the person described in Kan. Stat. Ann. 2023 Supp. 50-6,118, and amendments thereto, has a written contract with the performing or recording group, that states that:
(a) The performing group is an authorized registrant pursuant to subsection (a) of Kan. Stat. Ann. 2023 Supp. 50-6,118, and amendments thereto; or

- Contract: A legal written agreement that becomes binding when signed.
- Person: means any individual, corporation, government, governmental subdivision or agency, business trust, estate, trust, partnership, association, cooperative or other legal entity. See Kansas Statutes 50-624
(b) at least one member of the performing group was a member of the recording group pursuant to subsection (b) of Kan. Stat. Ann. 2023 Supp. 50-6,118, and amendments thereto.
